  2. Contact with the Seller: email kontakt@frolo.pl, phone +48 732 620 806.
  3. These Terms and Conditions set out the rules for using the Store, placing orders, concluding and performing sales contracts, payment, delivery, withdrawal from the contract, and complaints.
  4. The Store sells and ships exclusively within the territory of the Republic of Poland.

§2 Definitions

  1. Customer – a natural person, legal person or organisational unit making a purchase in the Store.
  2. Consumer – a Customer who is a natural person making a purchase not directly related to their business or professional activity; the provisions concerning consumers also apply to a natural person entering into a contract directly related to their business activity where it follows from the content of the contract that it is not of a professional nature for them.
  3. Goods – the product offered in the Store (frolo polo shirts).
  4. Order – a declaration of intent by the Customer aimed at concluding a sales contract.

§3 Conditions of Using the Store

  1. To use the Store, a device with internet access and a web browser is required.
  2. Purchasing in the Store does not require creating an account.
  3. Prices of Goods are given in Polish zloty (PLN) and are final (total) prices. The Seller benefits from the subjective VAT exemption under Art. 113 of the Goods and Services Tax Act; therefore, the prices of Goods do not include VAT.

§4 Placing Orders

  1. Orders can be placed 24 hours a day via the Store.
  2. After placing an order, the Customer receives an email confirmation containing the order summary.
  3. The sales contract is concluded when the Seller confirms acceptance of the order.
  4. The Seller reserves the right to refuse to fulfil an order if the Goods are unavailable. The Customer will be informed without delay and any funds paid will be refunded in full.

§5 Prices, Payment and Delivery

  1. The current price of the Goods is PLN 300 per item. Delivery within Poland via InPost (parcel lockers) is free of charge.
  2. Payments are processed via Shopify Payments (payment cards, BLIK and other methods available in the Store).
  3. The order is fulfilled once the payment has been credited.
  4. The standard time to prepare an order for dispatch (from the crediting of payment) is up to 2 business days. InPost delivery time is usually 2–4 business days. The total estimated waiting time from the crediting of payment to delivery is therefore up to 6 business days.

§6 Right of Withdrawal (Returns)

  1. A Consumer has the right to withdraw from a distance contract within 14 days without giving any reason, in accordance with the Act of 30 May 2014 on Consumer Rights.
  2. The detailed return procedure, including the methods of sending back the Goods and the rules for refunding payment, is described in a separate document: the Returns Policy, available on the Store’s website.
  3. The Goods offered in the Store (frolo polo shirts) are prefabricated, mass-produced in standard sizes and designs independently of the Customer’s specific order. They are therefore not goods made to the Customer’s specification or personalised within the meaning of Art. 38 point 3 of the Consumer Rights Act. The Consumer’s right of withdrawal therefore applies under the general rules described in this section.

§7 Complaints (Non-Conformity of Goods with the Contract)

  1. The Seller is liable to the Consumer for any lack of conformity of the Goods with the contract under the rules set out in the Consumer Rights Act (Chapter 5a).
  2. A complaint can be submitted to kontakt@frolo.pl, stating the order number and a description of the non-conformity (photos are welcome).
  3. The Seller will process the complaint within 14 days of receiving it.
  4. If the Goods do not conform to the contract, the Consumer is entitled to demand repair, replacement, a price reduction or withdrawal from the contract, under the rules set out in the Act.

§8 Out-of-Court Dispute Resolution

  1. The Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular through permanent consumer arbitration courts operating at the Voivodeship Inspectorates of Trade Inspection, or mediation conducted by the Voivodeship Inspector of Trade Inspection. A list of entities authorised to resolve consumer disputes out of court in the EU is available at: consumer-redress.ec.europa.eu/dispute-resolution-bodies.
  2. The Consumer may also seek assistance from the competent Voivodeship Inspectorate of Trade Inspection or a county/municipal consumer ombudsman.

§9 Personal Data

The rules for processing Customers’ personal data are described in the Privacy Policy, available on the Store’s website.

§10 Final Provisions

  1. The Seller reserves the right to amend these Terms and Conditions for important reasons (e.g. a change in the law or in the scope of business). Amendments do not affect orders placed before they enter into force.
  2. In matters not regulated by these Terms and Conditions, Polish law applies, in particular the Civil Code and the Consumer Rights Act.
  3. These Terms and Conditions are available free of charge on the Store’s website in a form that allows them to be obtained, reproduced and stored.
